Inner Mongolian Autonomous Region Shiliin-Gol League’s ( Xi Lin Guo Le Meng ) Provisional Regulation on Implementing the Policies of Strategic Encircling and Transferring

 

Article 1

In order to ensure the smooth implementation of entire League’s encircling and transferring strategy, this provision is stipulated with consideration of our League’s actual situation, in accordance with the related laws of the Autonomous Region and policies of the government.

Article 2

In order to carry out environmental immigration, on-the-spot prohibition of livestock grazing, spring season temporary prohibition of livestock grazing, zoning the rotational herding areas, the People’s Governments of various Banners ( Qi ), Counties ( Xian ), Cities ( Shi ), and Areas ( Qu ) shall allocate certain amounts of productive inputs and supplies to the areas after the Banner ( Qi ), County ( Xian ), City ( Shi ), and Area’s ( Qu ) authorities concerned, Soms ( Su mu ), Villages ( Xiang ), Townships’ ( Zhen ) people’s governments, Gachaa Villager’s Committees sign for the contract, in accordance with the variety of situation.

Article 3

Extremely poverty-stricken households who have lost their basic production and management capacities because of the variety of reasons in the environmental immigration resettlement areas shall be provided with the basic living salvages through the Civil Administration, help-the-poor and social benefit authorities, and their children those who willing to receive education shall be awarded a certain amount of aid by Banner ( Qi ), County ( Xian ), City ( Shi ), and Area’s people’s governments.

Article 4

Environmental immigrants and on-the-spot livestock prohibited households shall be exempted from the “ Three Taxes of Animal Husbandry”. Spring season temporary livestock prohibition households shall be deducted of the “Three Taxes of Animal Husbandry”. Those of herders who are engaged in the second and third industries in the environmental immigration resettlement areas shall be exempted from various taxes excluding the business tax, value-added tax, consumption tax for 3 years. Those who are categorized as the farmers of national forest-and-grass-returning fallow land areas shall be exempted from the agricultural special product tax for 10 years counting from their income-earned date in accordance with the state related regulations and policies.

Article 5

Agricultural tax shall be deducted and a full-coverage of financial aid shall be provided in the livestock prohibition areas, spring season temporary livestock prohibition areas, forest-and-grass-returning fallow land areas, through financial transfer.

Article 6

Right to use grasslands remains untouched after the grassland encircling and stock grazing prohibition are put into force. After more than 5 years grassland encircling and stock grazing prohibition, herder’s households who apply for reusing the grassland shall be allowed to reuse the grasslands scientifically and rationally under the strict regulation of controlling the grassland-livestock balance if the grassland administration authorities’ determination of vegetation recovery allows the reuse and the people’s governments of Banner ( Qi ), Counties ( Xian ), Cities ( Shi ), and Areas ( Qu ) approve it.

 Article 7

Herder’s and farmer’s households whose pasture lands and farm lands have been occupied because of the environmental immigration resettlement process shall receive a proper lump-sum payment from the people’s governments of Banner ( Qi ), Counties ( Xian ), Cities ( Shi ), and Areas ( Qu ).

Article 8

Encourages and leads various type of enterprises and individuals to start forage-planting and forage-processing businesses in the encircling and transferring areas in accordance with the regulations and plans. Those who are engaged in forage-planting business shall be exempted from the agricultural special product tax for 5 years and the agricultural tax for 10 years; those who are engaged in forage-processing business shall be exempted from the value-added tax and income tax.

Article 9

Increase the input of implementing the encircling and transferring strategy through various channel.

1.      Funds for the development of environmental, agricultural, animal-husbandry, forestry, and water resource industries, help-the-poor and exploitation industries, agricultural comprehensive exploitation industries shall be allocated properly for the selected areas’ projects in accordance with the encircling and transferring regulations and plans, giving the number one priority to the stock-grazing prohibition areas, desert-combat areas, rotational herding areas, and forest-and-grass-returning fallow land areas, under the principles of “laying stress on the key points, concentrating the scattered, and giving comprehensive treatments”.

2.      Help-the-poor and exploitation shall focus on the complete solution of poverty-stricken farmers and herders’ production and living problems, giving priority to bring the encircling and transferring project areas’ poverty-stricken Gachaas and Villages into line with the Autonomous Region’s “A Thousand Villages’ Help-The-Poor and Exploitation” project. Help-the-poor social work shall place stress upon helping the poverty-stricken Gachaas and households in the encircling and transferring areas.

3.      Authorities of water resources, transportation, electricity, communication, media shall ensure these “five are unobstructed” in the encircling and transferring areas by favoring the programs on arrangement.

Article 10

Enhancing the credit loan to support the encircling and transferring strategy.

1.      Various levels of financial authorities shall put stress upon the works providing credit loan service to the encircling and transferring strategy, and shall set up a special loan to increase the long-term loan for production, and shall actively organize funds and improve the investment.

2.      Mortgage range shall be widened. Farmers and herders households in the encircling and transferring areas could use their real property such as houses and fences as mortgage to start a farmers and herders joint credit loan business. Encourage the key enterprises or farmers and herders’ economical joint organizations to jointly receive loans, give out the loans and call in the loans. Various level of governments shall earmark a fund to pay the partial interest.

Article 11

During the implementation process of the encircling and transferring strategy, 50-70% of infrastructure such as houses, shelters, fences, and wells that are invested and built by the state shall be owned by farmers and herders households if they strictly implement the encircling and transferring regulations. The rest of the 30-50% shall be returned to the state within 5-8 years, however, the property right shall be belonging to farmers and herders households after returned. If the implementation of the encircling and transferring strategy is not strict, the property right of the infrastructure that are invested by the state shall be returned to the state on an annual basis. The concrete returning rate and deadline shall be defined by the people’s governments of various Banners ( Qi ), Countis ( Xian ), Cities ( Shi ), and Areas ( Qu ), in accordance with local economic levels and farmers and herders economical situation. Returned fund shall be re-used as a special fund for the encircling and transferring project by the Banners ( Qi ), Countis ( Xian ), Cities ( Shi ), and Areas ( Qu ).

Article 12

Starting from 2002, setting up pastures in pasture areas by various units, entities, enterprises and occupying pasture land to herd livestock and raise livestock at herder’s home by various type of non-pasture individuals shall be forbidden in principle. Those of units and individuals mentioned above who have already started  operating pasturage, herding or raising livestock shall be cleaned up by the people’s government of various Banners ( Qi ), Countis ( Xian ), Cities ( Shi ), and Areas ( Qu ). Scientific research and technology popularization bases, intensive management model bases, re-employment bases for unemployed urban population, work-study bases, frontier guards’ living bases shall be re-approved to continue their management under the local area policy, strictly implementing the encircling grassland and prohibiting livestock-herding, spring season temporarily prohibition of livestock herding, rotating and zoning the livestock herding, returning the forest and grassland. Funds for these shall be raised by themselves.

Article 13

According to the related laws, regulations, and requests for the encircling and transferring strategy, the people’s government at various level shall stipulate and perfect the laws and regulations to make a further control over livestock population, keep the grassland-livestock balance, and forcefully implement the over-limit livestock selling out plan. Those who are not implementing the policy shall be punished in accordance with the “Inner Mongolian Autonomous Region’s Grassland-Livestock Balance Provisional Regulation”.

Article 14

The people’s governments at various level, in accordance with the “Grassland Law”, “Forest Law”, “Water And Land Protection Law”, “Law For Preventing And Combating The Desert”, shall protect and manage resources of grassland and forests. Substantiate and tighten the forest public security, forest administration, grassland supervision and administration, water and land protection, strengthening the implementation of law. Create and improve public administration and protection organizations and teams to tighten the supervision and administration of grassland and infrastructure in project areas. Put local herders’ families to watch the encircled areas along public traffic lines. Funds needed for this shall be provided by the financial authorities at various level as a special allocation, or properly earmarked from the project fund in accordance with the regulation.

Article 15

Positively promote industrialized management. Tightly combine farmers and herders interests. Agricultural and animal by-product key industries who have played important role during the management industrializing process shall enjoy the related policies of “Shiliin Gol League ( Xi Lin Guo le Meng ) Animal Husbandry Industrialization Preferential Policy Regulation”, and shall be given priority to use the state investment to build up their infrastructure.

Article 16

Various level of scientific, technological authorities and professional institutions shall provide farmers and herders in the environmental immigration areas, on-the-spot livestock prohibition areas, spring seasonal temporary livestock prohibition areas, rotational herding zoon, and forest-returning and grass-returning areas, with a free technical training and tutoring; shall encourage scientific and technical persons to enter the encircling and transferring project areas to contract for conducting technical activities and promoting technical performance; those of farmers and herders who are tutoring the technical training shall be provided with proper subsidies. Funds for this shall be earmarked properly from the project fund. Technical persons who provided technical services shall be guaranteed to receive their traveling fees and necessary business expenses.

Article 17

Actively guide herders to move into urban areas and start second and third industries.

1.      herders who have been relocated into urban areas to engage in second and third industries after the livestock prohibition shall be given the number one priority to complete their various formalities without any charges by the industrial and commercial authorities, tax administration, health department, public security, urban construction authorities, urban land administration, if they show their personal identity card ( or residential booklet ) and a reference letter from any of the people’s governments of Banner ( Qi ), County ( Xian ), City ( Shi ), Area ( Shi ) and Sumu ( Su Mu ), Village ( Xiang ),Township ( Zhen ). Application of business license shall be free except the cost of license itself; anyone who has legal residential address and steady income sources shall be approved to obtain an urban residential identity ( Cheng Zhen Hu Kou in Chinese ) if the application is done by applicant himself or herself; application for residential and business proposed land shall be given priority to be approved in accordance with the urban area regulations without any charges; herders who have started the third industry shall be exempted from various taxes except the business tax for 3 years in accordance with the land-taxation authorities’ examination.

2.      when hiring employees, new industries and enterprises shall hire a certain rate of farmers and herders who are from the encircling and transferring areas, and the farmers and herders shall be treated as unemployed population to enjoy the related policies. The concrete methods shall be stipulated by the labor, social security and other authorities concerned.

3.      in accordance with the regulations of the encircling and transferring strategy, educational authorities shall rationally re-arrange the school distribution in the farmer’s village and herder’s areas, and properly concentrate the schools to urban areas; key schools who meet the requirement of the encircling and transferring strategy shall be supported in policy and investment by various government. Students from herders families in the encircling and transferring project areas who could not be enrolled in college and professional school after graduating high school shall be provided with a 2-month free technical training in urban areas in order to be employed in urban areas.

Article 18

Establish the encircling and transferring strategy special reward system to give award to cadres, employees, scientific workers, farmers and herders who have made a remarkable achievement during the project.

Article 19

The people’s governments of various Banner ( Qi ), County ( Xian ), City ( Shi ), and Area ( Qu ) shall stipulate the concrete and detailed regulations by considering the situation of local areas in accordance with this regulation.

Article 20

State-owned farms and pasturages who have already rent out their farmlands and grasslands to individual families shall implement the encircling and transferring in accordance with this regulation.

Article 21

The League’s Encircling and Transferring Strategy Leading Group shall be responsible for the interpretation of this regulation.

Article 22

This regulation shall come into forth from the date of issuance.
